Hi Oleg
This kind of conservation easement might survive a tax deed in Florida, but it really depends on the details. Things like when it was recorded, who holds it, and whether it actually serves a real conservation purpose all matter. Some do stick, others don’t, there’s no one-size-fits-all answer.
To figure out if it can be removed, you really need a Florida real estate attorney who deals with title issues. The usual routes are a quiet title action or a declaratory judgment, but which one makes sense depends on the facts. It’s definitely not something to guess on, a specialized attorney can look at the history and tell you pretty quickly how strong the case is.
good luck!
I used to require these to be placed on properties. My understanding is sometimes older ones were defeated, but newer ones are iron clad. I would be surprised if you were able to remove this easement. Note a lot CE's allow a single family home.
